Policy for Agent and Advisor Registration
 
Agent/Advisor Registration Form
 
  1. Applicable Bylaw(s): 12.3.1
     
  2. Purpose: To ensure all student-athletes and athletics department staff members receive education on NCAA legislation and follow institutional policies concerning agents/advisors.  

  3. “Agent” Defined: An agent is any individual who, directly or indirectly, (a) represents or attempts to represent an individual for the purpose of marketing his or her athletics ability or reputation for financial gain; or (b) seeks to obtain any type of financial gain or benefit from securing a prospective student-athlete’s enrollment at an educational institution or from a student-athlete’s potential earnings as a professional athlete.

    1. An agent may include, but is not limited to, a certified contract advisor, financial advisor, marketing representative, brand manager or anyone who is employed or associated with such persons.

  4. Agent Registration Procedure: Agents must complete the following application process to become Approved Agents.  Only Approved Agents may contact current student-athletes pursuant to the procedure outlined in Paragraph 6, below:

    1. Agents must be registered with the appropriate professional league (e.g., NFLPA), State of Oregon Department of Education, and the PSU Compliance Office.
    2. Agent must submit a complete and accurate Agent/Advisor Registration Application Form (“Application Form”) to the Compliance Office.
    3. The Application Form must include all requested certification information contained on the form, including a copy of the individual’s State of Oregon Athlete Agent Permit.
    4. Incomplete Application Forms will not be processed until all requested information has been received by the Compliance Office.
    5. The Compliance Office will verify credentials by contacting the appropriate professional league, and provide notification of completed approved applications to the Agent via e-mail.
    6. Approved Agents must notify the Compliance Office of any major changes to the information provided on the Agent’s Application Form, and this notification must be provided within two weeks of the change’s occurrence.  Major changes include, but are not limited to, an applicant’s registration with the appropriate professional league, the State of Oregon Department of Education (or State Bar if applicable), or violations of NCAA legislation.  Failure to notify the Compliance Office within two weeks may result in the revocation of the agent’s approved status.
    7. Approved Agents without major changes in the information provided in their application, maintain their approved status for a cycle beginning October 1st and ending September 30th.  Each cycle year (October 1 – September 30).  Agents wishing to renew their Application Form must confirm in writing to the Compliance Office that all information on their Application Form remains the same.  Agents whose Application Form expires, either through a failure to renew or because their renewal application was denied, are no longer Approved Agents.
    8. Information on the forms will be made available for interested student-athletes to review inside the Compliance Office only.  
    9. The approved forms will be kept on file in the Compliance Office.

  1. Procedures for Contact Between Approved Agents and Current Student-Athletes: Approved Agents may contact current student-athletes only in accordance with the following procedure:

    1. If a meeting is arranged, the Compliance Office must be notified by the agent of the meeting date and time at least two hours in advance so that a compliance staff member has the opportunity to attend, and the meeting must occur on the PSU campus.
    2. If the Compliance Office has reasonable belief that an athlete agent/advisor, their employee and/or representative has attempted to contact an PSU student-athlete without following procedures, the violation will be reported to the appropriate agency having jurisdiction in the area where the alleged violation has taken place.  All associated with the violating individual may be trespassed from the PSU campus.
    3. Failure to comply with this policy may result in the revocation of the agent’s approved status.
